By downloading, installing, or using PetSense, you agree to be legally bound by these Terms. If you do not agree, do not use the app.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and an individual entrepreneur registered in Portugal ("PetSense," "we," "us," or "our"), governing your access to and use of the PetSense mobile application and any related services, features, content, or websites (collectively, the "Service").
If you are using PetSense on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
These Terms apply to all users of the Service including, without limitation, registered account holders, visitors, and contributors of content.
PetSense expressly disclaims any liability for harm, injury, deterioration, or death of any animal resulting from a user's reliance on, or failure to act upon, any information, analysis, or recommendation provided by the Service.
The Health Calendar and reminder features are organizational tools only. PetSense does not guarantee the medical accuracy of suggested vaccination schedules, deworming intervals, or any other care suggestions. All such schedules must be validated by a licensed veterinarian who has examined your specific animal.
You must be at least 18 years of age, or the age of legal majority in your jurisdiction (whichever is greater), to create an account and use the Service.
You agree to provide true, accurate, current, and complete information during registration and to update such information as necessary to keep it accurate and current.
You are solely responsible for maintaining the confidentiality of your account credentials. You agree to notify PetSense immediately at info@petsense.app if you suspect unauthorized access to your account.
You may not create multiple accounts for the purpose of circumventing usage limits, accessing features reserved for paid plans, or any other fraudulent purpose.
PetSense reserves the right to suspend or terminate your account at any time, with or without notice, for any breach of these Terms or for any reason at our sole discretion.
Subject to your compliance with these Terms, PetSense grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App solely on a device you own or control, for your personal, non-commercial use.
PetSense may issue updates to the App from time to time. Such updates may be required to continue using the Service. These Terms apply to all updates and new versions of the App.
The AI Analysis feature uses computer vision and algorithmic processing to analyze photographs submitted by users. Outputs are probabilistic in nature and are generated without any human clinical review. All AI outputs are explicitly labeled as informational estimates, not clinical diagnoses.
PetSense is an AI-powered companion app for pet wellness organization. It is not a medical device, a clinical decision support tool, or a regulated health technology product. It is not intended to diagnose, treat, cure, or prevent any disease or health condition in animals.
AI Analysis may be subject to usage limits depending on your subscription tier. PetSense reserves the right to modify usage limits at any time.
The Health Calendar is a scheduling and reminder feature designed to assist users in tracking pet care events they choose to record. It is not a clinical tool and does not constitute veterinary advice.
PetSense does not guarantee the timely delivery of push notifications or reminders. Notification delivery depends on device settings, operating system behavior, network connectivity, and other factors outside PetSense's control. Failure to receive a reminder does not constitute a failure of duty by PetSense, and we accept no liability for missed veterinary appointments, vaccinations, medications, or other care events attributable to non-delivery of reminders.
Suggested vaccination schedules or health events generated by the App are based on general breed and age data and may not reflect the specific needs of your individual animal. Always consult a veterinarian to create a care plan tailored to your pet.
PetSense offers a free tier with limited features. PetSense reserves the right to modify, restrict, or discontinue the free tier at any time with reasonable notice.
Premium subscription plans are offered at the prices displayed within the App at the time of purchase. Prices are listed in Euros (EUR) unless otherwise stated. All prices are inclusive of applicable VAT where required.
Subscriptions are billed in advance on a recurring basis (monthly or annually, as selected). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
Payments are processed through Apple App Store (iOS) or Google Play Store (Android) billing systems. PetSense does not store payment card information.
Where a free trial period is offered, your subscription will automatically convert to a paid subscription at the end of the trial unless you cancel before the trial expires.
You may cancel your subscription at any time through your App Store account settings. Cancellation will take effect at the end of the current billing period. You will retain access to premium features until the end of the paid period.
If you are a consumer located in the European Union and you purchase a Premium subscription, you may have a statutory right of withdrawal within 14 days of your first purchase. However, by accessing Premium features immediately upon purchase, you expressly consent to the immediate performance of the service and acknowledge that you will lose your right of withdrawal once you begin using the premium features.
PetSense reserves the right to change subscription pricing. We will provide reasonable notice of any price changes before they take effect.
You retain ownership of all Content you submit to the Service.
By submitting Content through the Service, you grant PetSense a worldwide, royalty-free, non-exclusive, sublicensable license to use, store, reproduce, process, and display your Content solely for the purposes of operating, maintaining, and improving the Service, and anonymizing and aggregating data for research purposes, in accordance with our Privacy Policy.
PetSense may use anonymized, de-identified, and aggregated data derived from user interactions for product improvement, research, and business purposes. Such data will not identify you personally.
You are solely responsible for ensuring that any Content you submit does not violate any applicable law or third-party rights, is accurate and not misleading, and does not contain viruses, malware, or other harmful code.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
PetSense processes personal data in accordance with Regulation (EU) 2016/679 (GDPR). As an individual entrepreneur registered in Portugal, PetSense is subject to EU data protection law.
As a data subject under GDPR, you have the right to access, rectify, erase, restrict, and port your personal data, to object to processing, and to withdraw consent at any time. To exercise these rights:

We retain your data for as long as your account is active or as necessary to provide the Service. Upon account deletion, we will delete or anonymize your personal data within a reasonable period, except where retention is required by applicable law.
The Service, including but not limited to the App, its design, code, algorithms, AI models, logos, trademarks, trade names, graphics, text, and all other content created by PetSense, is the exclusive property of PetSense and is protected by applicable intellectual property laws.
Nothing in these Terms transfers any intellectual property rights to you. The limited license granted in Section 5 does not constitute a sale or transfer of any ownership interest.
"PetSense" and all associated logos and marks are trademarks of PetSense. You may not use our trademarks without prior written permission.
If you provide feedback, suggestions, or ideas regarding the Service, you grant PetSense a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without compensation or attribution to you.
The Service may integrate with third-party services including Google Firebase, Google Vision API, Apple App Store, Google Play Store, RevenueCat, and other analytics or infrastructure providers. These third parties have their own terms of service and privacy policies which you are responsible for reviewing.
PetSense is not responsible for the content, practices, or policies of any third-party service. Your interactions with third-party services are solely between you and the respective third party.
Third-party integrations may be discontinued, modified, or become unavailable at any time. PetSense is not liable for any impact on the Service caused by changes to third-party services.
Nothing in these Terms excludes or limits warranties or rights that cannot be excluded or limited under applicable mandatory consumer protection law in your jurisdiction.
If you are a consumer in the European Union, nothing in these Terms limits PetSense's liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded or limited under applicable mandatory EU consumer law.
These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.
Before initiating any formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at info@petsense.app. We will use reasonable efforts to resolve disputes within 30 days.
If informal resolution fails, any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Portugal, except where mandatory consumer protection law in your country of residence grants you the right to bring proceedings before the courts of that country.

Any claim arising under these Terms must be brought within one (1) year after the cause of action accrues, to the extent permitted by applicable law.
PetSense reserves the right to modify these Terms at any time. We will notify you of material changes via in-app notification, email, or by posting updated Terms within the App with a new "Last Updated" date.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. For EU consumers, we will provide at least 30 days' advance notice of material changes that negatively affect your rights.
You may terminate your account at any time through the App settings or by contacting info@petsense.app. Termination does not entitle you to any refund of prepaid subscription fees.
PetSense may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Grounds for termination include but are not limited to breach of these Terms, suspected fraud, illegal activity, or extended inactivity.
Upon termination, the license granted to you immediately ceases. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 3, 11, 14, 15, 16, 17, and 20.
